Security Guard Will Not Face Charges in Fatal Shooting

Prosecutor Kym L. Worthy has determined that no charges will be issued in the fatal shooting of Thomas McIntosh, 55, of Detroit because he acted in lawful self-defense. On August 27, 2013 at approximately 3:00 a.m., at an apartment building in the 1100 block of West Warren, a 77-year-old male security guard was on duty when McIntosh entered the apartment building where he resided. McIntosh appeared intoxicated and was extremely agitated when he walked toward the guard and threatened to physically harm him. McIntosh was unarmed but continued to walk closer. When the 77-year-old warned McIntosh against approaching, he pulled out his registered handgun and held up his other hand, signaling McIntosh to stop. McIntosh had a significant height and weight advantage over the 77-year-old guard. When McIntosh continued walking, the guard fired a single shot, killing McIntosh. The guard waited for the police to come and gave a statement at the scene stating that he acted in self-defense. There were two independent eyewitnesses who observed the entire incident. The witnesses corroborate the facts in support of the claim of self-defense.

No charges will be issued in this matter because the guard acted in lawful self defense; he honestly and reasonably believed the use of deadly force was necessary under the facts to protect himself from death or great bodily harm and he had no duty to retreat.

"After weighing all of the evidence in this case, we have determined that the actions of the security guard constituted a clear case of self defense," said Prosecutor Worthy.

Off-Duty Detroit Transit Officer Charged in Fatal Shooting Death

Today Robert Tyus, 52 (DOB 5/30/60), has been charged in connection with the fatal shooting of Jordan West-Morson, 26, both of Detroit. It is alleged that on May 1, 2013, at approximately 7:45 p.m., West-Morson was at a gas station at 15000 East 8 Mile Road selling CDs, when he had a verbal argument with Tyus, who identified himself as a Detroit transit officer. The argument escalated into a fist fight with Tyus. During the fist fight, it is alleged that Tyus pushed WestMorson away causing him to stumble backwards. At that time, Tyus drew his gun and fired one shot, killing West-Morson. He was pronounced dead on arrival at a local hospital. Further facts and evidence in this case will be placed on the record in court at the preliminary examination.

Tyus has been arraigned on charges of Manslaughter and Felony Firearm. He will have a preliminary examination on September 30, 2013, 36th District Court. He received a 100,000/10% bond. Please contact the Detroit Police Department for a photograph of the defendant.

Robert Bashara - Charged with murder in connection with killing his wife Jane Bashara. On Friday, September 20, 2013 at 9:00 a.m., he will be arraigned on the information before Judge Vonda Evans. Bashara is expected to appear in court tomorrow.

Romulus Criminal Sexual Conduct Case - We have received a warrant request that is currently being reviewed for a CSC that occurred on September 10th in Romulus involving a 72-year-old woman. When a decision has been made, updated information will be sent out.

Prosecutor Worthy to Appear on the Katie Couric Show on September 23, 2013

Wayne County Prosecutor Kym Worthy is scheduled to appear on the Katie Couric Show on Monday, September 23, 2013, at 3:00 p.m. on the local ABC affiliate WXYZ. She will discuss the Detroit Rape Kit Project that is grant funded by the National Institute of Justice. The project resulted after over 11,000 untested rape kits were discovered in 2009 at an old Detroit Police Department storage warehouse. Also featured on the show is Mariska Hargitay of Law and Order: SVU. In 2004, she established the Joyful Heart Foundation, an organization for groups working with women and children who have been sexually abused. Joyful Heart is collaborative partner on the Detroit Rape Kit Project.

Robert Bashara - Charged with murder in connection with killing his wife, Jane Bashara. Today he was arraigned on the information before Judge Vonda Evans. She set a final conference date of December 11, 2013 at 9:00 a.m. and a trial date of March 3, 2014.

Romulus Man Charged with Rape of Senior Citizen

Today Prosecutor Kym L. Worthy has charged Ryan Curtis Curcio, 25 (DOB 6/3/88), of Romulus in connection with the sexual assault of a 72-year-old female in her home located on Riverbridge in Romulus. It is alleged that on September 10, 2013, at approximately 5:45 a.m. Curcio, while armed with a sharp metal object, entered the woman's home without permission, sexually assaulted her and committed an armed robbery, taking her personal possessions.

Curcio has been charged with the following: Count 1 - Home Invasion First Degree; Count 2 - Armed Robbery; Counts 3 and 4 - Criminal Sexual Conduct, First Degree; Count 5 - Criminal Sexual Conduct, Fourth Degree; Count 6 - Larceny in a Building and Count 7 - Interfering with Electronic Communication Device.

The defendant is expected to be arraigned at 2:00 p.m. today in 34th District Court in Romulus. Please contact the Romulus Police Department to request a photograph of the defendant.
