Charges to be Amended in Fatal Hit and Run Car Crash

Cortney Shields, 23 (3/5/91), and Leonard Crosby, 18 (4/11/96) both of Detroit were charged on Sunday, May 25, 2014 in connection with the hit and run car crash that occurred on May 19, 2014 at 4:20 p.m. at Robson and Eaton killing 8-year-old Kamari Smith of Detroit. On Sunday, May 25, 2014 the victim died in a local hospital where she was being treated for injuries sustained in the crash.

Mr. Shields, the driver of the car was originally charged with Reckless Driving and Failure to Stop at the Scene of an Accident Causing Serious Injury or Death. On Wednesday, May 28, 2014, his charges will be amended to Second Degree Murder (Life or any term of years), Reckless Driving Causing Death (15 years) and Failure to Stop When at Fault Causing Death (15 years). Arraignment information will be provided tomorrow.

Mr. Crosby has been charged with Accessory After the Fact to a Felony to a Felony on May 25, 2014; his charges are expected to remain the same.

Shields was arraigned today in 36th District Court and remanded to jail. Both defendants will have their preliminary examinations before Judge Alicia Jones-Coleman on June 10, 2014.

Robert Tyus - Off-duty transit officer charged in connection with the fatal shooting of a man at an East Eight Mile gas station in Detroit. Today a witness failed to appear for the trial and the prosecution requested an adjournment from the court that was denied. Judge Margaret Van Houten dismissed the case without prejudice. The Wayne County Prosecutor's Office will re-issue the case.

Steve Utash Case - The final conference hearing for adult defendants Wimbush, Cummings, Davis and Saffold scheduled for Friday, June 2, 2014 has been re-scheduled for June 16, 2014 at 9:00 a.m. before Judge James Callahan.

Detroit Man Charged in Homicide of Step-Father and Non-Fatal Shooting of Mother

Prosecutor Kym L. Worthy has charged Antonio James Hicks, 19 (DOB: 11/10/94) in the homicide of his mother and step-father. On It is alleged that on May 27, 2014 at approximately 7:30 a.m., Hicks fatally shot Johnny Clyburn, 41, after an argument and then shot and injured his mother Nicolina Pace, 40, in their home located in the 5900 block of Woodhall in Detroit. After the shooting, the defendant fled the location and Ms. Pace called 911. Mr. Clyburn and Ms. Pace were transported to a local hospital where he died of multiple gunshot wounds and she was treated for her injuries.

Hicks is charged with First Degree Murder, Assault with Intent to Murder and Felony Firearm. He is expected to be arraigned tomorrow morning at 10:30 a.m. in 36th District Court.

Byron Miles - Double homicide of a mother and son resulting from Detroit arson fire on November 1, 2013. The defendant is the son and the brother of the victims. Today he was sentenced to 35 to 65 years on the charges of Second Degree Murder and Arson.

Michael St. Andre - Former Romulus police chief charged in corruption probe. Today at a special pre-trial hearing, St. Andre pleaded guilty to one count of Conducting a Continuing Criminal Enterprise (20 years), Embezzlement by a Public Official (10 years) and Misconduct in Office (five years). He will be sentenced on October 17, 2014 before Judge Michael Hathaway. The former chief's wife, Sandra Vlaz St. Andre, was previously sentenced to seven to 20 years in the Michigan Department of Correction on February 20, 2014. Defendants Richard Balzer, Richard Landry and Donald Hopkins will have a jury trial before Judge Michael Hathaway on August 4, 2014 at 9:00 a.m. See the attached Weekly Updates at page 38 for further information about this case.

Antonio James Hicks - Hicks was arraigned today on charges of First Degree Murder, Assault with Intent to Murder, and Felony Firearm. His Preliminary Examination is scheduled for Tuesday, June 10, 2014 at 1:30 p.m. before Judge Michael Wagner in 36th District Court.
